1. Acceptance and eligibility
By creating a Forktail account, joining an early-access program, or using the Forktail service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Forktail.
You must be at least 18 years old and legally able to enter into these Terms. You may connect and use only financial accounts that you own or are authorized to access.
2. What Forktail provides
Forktail is an informational software service that helps you organize connected accounts and transactions, review spending, create money plans, estimate Safe to Spend amounts, receive alerts and insights, and ask AI-assisted questions about your financial data.
Forktail does not hold, transfer, invest, or custody money. Forktail does not initiate bank transfers, card payments, securities trades, or other financial transactions.
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use Forktail for your own lawful, non-commercial purposes, subject to these Terms and any applicable app-store rules.
3. Your Forktail account
- Provide accurate account information and keep it current.
- Keep your Forktail credentials, device, and authentication methods secure.
- Notify us promptly if you suspect unauthorized access.
- Accept responsibility for activity through your account unless applicable law says otherwise.
We may require email verification or other reasonable steps to protect your account. You may not share access in a way that defeats Forktail’s user-level security controls.
4. Financial information and Safe to Spend
Balances, transactions, categories, due dates, merchant data, and other financial information can be delayed, incomplete, duplicated, miscategorized, or changed by a financial institution or connection provider. Always confirm time-sensitive or high-stakes information with the relevant financial institution.
Safe to Spend, cash forecasts, projected balances, detected subscriptions, alerts, and plan status are estimates based on the latest information available to Forktail and on assumptions or preferences that you approve. They are not a guarantee that funds are available, that a payment will clear, or that an account will avoid fees, overdrafts, interest, or other consequences.
You are responsible for reviewing plan assumptions, due dates, recurring items, account balances, and proposed changes. Forktail will not apply a money-plan change that requires your approval until you approve it, but data updates and derived calculations may still change automatically as new information arrives.
5. Not professional advice
Forktail provides general educational and informational tools. Forktail is not a bank, broker-dealer, investment adviser, financial planner, accountant, law firm, credit-repair organization, or fiduciary. Nothing in Forktail is personalized legal, tax, accounting, investment, lending, or other regulated professional advice.
You remain responsible for financial decisions and outcomes. Consider consulting a qualified professional before making decisions involving investments, taxes, debt, insurance, retirement, legal rights, or other significant matters.
6. AI-assisted features
Forktail uses automated systems, including third-party AI services, to generate responses, summaries, classifications, and insights. AI output may be inaccurate, incomplete, outdated, or unsuitable for your situation even when it sounds confident.
- Review AI output before relying on it.
- Do not use Forktail as the sole basis for an urgent or high-stakes decision.
- Do not submit information you are not authorized to share.
- Do not use AI output to make decisions about another person’s eligibility for employment, housing, credit, insurance, education, or another high-impact domain.
7. Connected accounts and third-party services
Forktail uses providers such as Plaid and Akoya to connect supported financial institutions. When you start a connection, you may also agree to the provider’s and financial institution’s terms and privacy practices. Forktail does not control their availability, data, authentication steps, or decisions.
You authorize Forktail and its providers to retrieve, process, and refresh the account information you select for the purposes described in the Privacy Policy. You can revoke access by disconnecting the institution in Forktail or through the provider or institution where supported.
Forktail may contain links to third-party sites or services. Those third parties are responsible for their own content, terms, privacy practices, and security.
8. Your content and feedback
You retain ownership of questions, plan details, feedback, screenshots, and other content you submit. You give Forktail a limited license to host, copy, transmit, process, display, and modify that content only as needed to operate, secure, support, and improve the service, comply with law, and fulfill your requests.
Do not submit content that is unlawful, infringes another person’s rights, contains malware, or includes financial credentials or sensitive information that is unnecessary for the feature you are using.
If you send product ideas or suggestions, Forktail may use them without restriction or compensation, but this does not transfer ownership of your personal financial data.
9. Acceptable use
You may not:
- Use Forktail for unlawful, fraudulent, deceptive, abusive, or harmful activity.
- Access another person’s account or connect an account without authorization.
- Probe, attack, overload, scrape, or interfere with Forktail or its providers.
- Bypass access controls, usage limits, or security features.
- Reverse engineer or copy Forktail except where applicable law expressly permits it.
- Use automated means to create accounts, submit waitlist entries, or extract data without written permission.
- Resell, sublicense, or commercially exploit Forktail or its output without permission.
We may investigate suspected misuse and suspend or terminate access when reasonably necessary to protect users, Forktail, our providers, or the public.
10. Early access and changes
Some or all of Forktail may be offered as a beta, TestFlight build, preview, or invite-only service. Early-access features may be incomplete, change without notice, lose data, or stop working. Do not rely on a beta as your only financial record or alerting system.
We may add, change, limit, pause, or discontinue features or the service. We may also set or change usage limits. If Forktail later offers paid features, the price and any additional payment terms will be shown before you purchase.
11. Forktail ownership
Forktail and its software, design, branding, text, graphics, and other service content—excluding your content and third-party material—are owned by Forktail or its licensors and protected by intellectual-property laws. No rights are granted except the limited right to use the service under these Terms.
12. Suspension, termination, and account closure
You may stop using Forktail at any time. To request account and cloud-data deletion, follow the process in the Privacy Policy.
We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, misuse the service, or if operating the service is no longer practical. Where appropriate, we will try to provide notice and an opportunity to resolve the issue.
Sections that by their nature should survive termination—including ownership, disclaimers, limits of liability, and dispute-related provisions—will survive.
13. Disclaimers
To the fullest extent permitted by law, Forktail is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Forktail will be uninterrupted, error-free, secure, or accurate, or that every institution, account, transaction, bill, subscription, or financial event will be available or detected.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, Forktail and its operator, contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, savings, or data; overdraft or late fees; investment losses; or damages resulting from inaccurate or delayed financial data, AI output, unauthorized access, or service interruption.
To the fullest extent permitted by law, the total liability for all claims relating to Forktail will not exceed the greater of the amount you paid to Forktail in the 12 months before the claim or US $100.
These limits do not apply where prohibited by law or to liability that cannot legally be limited. You may have non-waivable consumer rights where you live.
15. Applicable law and resolving concerns
These Terms are governed by the laws that apply to Forktail’s operator, without regard to conflict-of-law principles, except where the law where you live gives you non-waivable rights. Before filing a formal claim, you agree to contact us and give both sides a reasonable opportunity to resolve the concern informally.
16. Changes to these Terms
We may update these Terms as Forktail changes. We will post the updated Terms and revise the effective date. If a change is material, we will provide additional notice when appropriate. Continued use after updated Terms take effect means you accept them; if you do not agree, stop using Forktail.
